Terms of Service

1. Acceptance of Terms
By accessing or using the NAFCOC website and Funding Watch platform (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
2. Platform Purpose
The Funding Watch platform enables South African entrepreneurs to document their experiences with funding institutions. NAFCOC provides this platform as an intermediary service under the Electronic Communications and Transactions Act (ECT Act), Sections 73–76.
3. User Responsibilities
When submitting case reports, you agree to provide truthful and accurate information based on your genuine experience, not submit content that is defamatory, fraudulent, or malicious, redact sensitive personal information such as ID numbers from uploaded documents, and not impersonate another person or submit cases on behalf of others without their consent.
4. Content Moderation
All case reports undergo a three-tier moderation process (automated screening, community review, and legal review) before publication. NAFCOC reserves the right to reject, edit, or remove submissions that violate these Terms or applicable law.
5. Institution Response
Institutions named in case reports have the right to submit a formal response. These responses are published alongside the original case to ensure fairness and balance.
6. Intellectual Property
By submitting a case report, you grant NAFCOC a non-exclusive, royalty-free licence to publish, display, and use your submission for the purposes of the Platform, including aggregated analytics, policy reports, and advocacy work.
7. Limitation of Liability
NAFCOC does not guarantee the accuracy of user-submitted content. The Platform is provided “as is” without warranties of any kind. NAFCOC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
8. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of Gauteng, Johannesburg.
